法律意义上的广告,是指商品经营者或者服务提供者承担费用,通过一定媒介和形式直接或者间接地介绍自己所推销的商品或者所提供的服务的商业广告。广告可以宣传、推销商品或推介服务内容,但广告也不是无所不包的,它也有法律上的禁区。《中华人民共和国广告法》第31条就对禁止发布广告的商品或者服务作出了原则规定。国家从保护社会公众和广大消费者利益出发,在不同的法律、行政法规中,规定了禁止生产、销售的商品或者提供的服务。对于此类商品或者服务,《广告法》规定,广告主、广告经营者、广告发布者均“不得设计、制作、发布广告”。这些法律、行政法规主要有:(1)《药品管理法》第33条规定:“禁止生产、销售假药。”第34条规定:“禁止生产、销售劣药。”(2)《食品卫生法(试行)》第7条规定:有12种食品禁止生产、经
Advertisements in the legal sense refer to the commercial advertisements that the merchandise manager or the service provider bear the cost of directly or indirectly introducing the goods they sell or the services they provide through certain media and forms.
