近年来,我国经济建设飞速发展,但是,一些地方片面强调发展经济,忽视环境保护,甚至污染和破坏生态环境,严重危害广大人民群众的生产、生活秩序和人身、财产的安全。对此,民众反映强烈,但却告状无门,而环保部门执法困难重重。为了全面落实科学发展观,坚持可持续发展战略,切实加强生态环境保护,应当建立环境公益诉讼制度,以法律手段来保护生态环境,维护国家利益和社会公共利益。本文对此进行初步的探讨。
In recent years, China's economy has developed rapidly. However, some places have unilaterally emphasized economic development, neglect of environmental protection, even pollution and damage to the ecological environment, seriously endangering the production and living order of the vast majority of the people and the safety of people and property. In response, the public reacted strongly but did not report it. However, the environmental protection department was having a lot of difficulties in enforcing the law. In order to fully implement the scientific concept of development, adhering to the strategy of sustainable development, and earnestly strengthening the protection of the ecological environment, environmental public interest litigation should be established to protect the ecological environment by legal means and safeguard national interests and social public interests. This article carries on preliminary discussion to this.
