我本科就读中南政法学院。刚上大学那会儿,学院恢复不久,地处武汉东郊的一片荒凉地。七弯八拐,来到宛若建筑工地的校园,有几幅醒目的标语:欢迎你,未来的法官!欢迎你,未来的检察官!欢迎你,未来的律师!你就是正义的化身!看到这些,当时很兴奋。这些标语里面,包含了一种期待,一种对法律的理解:法律是一项关于正义的事情,法律工作是一种从事正义活动的职业。这,也是民众对法律的一种朴素的情感。斗转星移,20年过去了,法律职业在变味。去年七月,我跟纽约哥伦比亚大学的Benjamin教授到荆州调研。有位法官说,法官其实是一种高风险的职业。我能理解他的意思。时下的工资待遇和人事制度,或许在“默许”司法的腐败,也在为法官的人格乃至整个社会良知“制造陷阱”。近年来,还出现过某某法院被“一锅端”的现象,就是这种职业风险的某种注释。
I enrolled in South China University of Politics and Law. Just went to college, college soon restored, is located in the wilderness of the eastern suburbs of Wuhan. Seven corners and eight turns, just like the construction site of the campus, there are several eye-catching signs: Welcome, the judge of the future! Welcome, the future prosecutors! Welcome to the lawyer of the future! You are the incarnation of justice! These are very excited at that time. These banners contain an expectation, a kind of understanding of the law: the law is a matter of justice, legal work is a career engaged in the activities of justice. This is also a simple feeling of the people on the law. Twists and turns, 20 years later, the legal profession is changing. Last July, I went to Jingzhou for a study with Professor Benjamin at Columbia University in New York. A judge said that judges are actually high-risk occupations. I can understand what he means. Nowadays, the wage and personnel system may be “acquiesced” in the corruption of the judiciary and “created a trap” for the judge's personality and even the entire social conscience. In recent years, there have been some courts that have been “pot-side” phenomenon, which is some kind of comment on this occupational risk.
