2001年12月11日修订并开始施行的国务院《旅行社管理条例》规定: 外国旅行社在中华人民共和国境内设立常驻机构,必须经国务院旅游行政主管部门批准;外国旅行社常驻机构只能从事旅游咨询、联络、宣传活动,不得经营旅游业务。外商投资旅行社的中国投资者应当符合下列条件:1.是依法设立的公司;2.最近三年无违法或者重大违规记录;3.符合国务院旅游行政主管部门规定的审慎的和特定行业的要求。外商投资旅行社的外国旅游经营者应当符合下列条件:1,是旅行社或者主要从事旅游经营业务的企业;
The Regulations of the State Council on Administration of Travel Agencies, which was revised and put into effect on December 11, 2001, stipulate that the establishment of a permanent establishment of a foreign travel agency within the territory of the People’s Republic of China must be approved by the tourism administrative department of the State Council. Resident agencies of foreign travel agencies may only engage in tourism consulting , Liaison, promotional activities, shall not operate tourism business. Chinese investors with foreign investment in travel agencies shall meet the following conditions: 1. They are companies established according to law; 2. They have no record of violations of laws or major violations in the recent three years; 3. They are in line with the prudent and industry-specific requirements stipulated by the tourism administration department under the State Council. Foreign tour operators with foreign investment in travel agencies shall meet the following conditions: 1. They shall be travel agencies or enterprises principally engaged in the business of tourism operation;
