刑事政策是保安处分的立论核心,在宽严相济刑事政策的视野下,我国的刑罚结构必须进行改革。保安处分制度中国化是改善我国刑法结构体系的题中之意,改善我国刑罚结构的轻重悬殊现象,发挥刑罚的最大功能。本文对保安处分中国化的理论进行了分析,并在宽严相济刑事政策视野下对保安处分中国化提出了自己的立法构想。
Criminal policy is the core of the argument of security punishment. Under the criminal policy of strict and lenientism, the penal structure in our country must be reformed. Sinicization of the security punishment system is the key to improving the structural system of criminal law in our country, improving the severity of penal structure in our country and giving play to the maximum function of punishment. This article analyzes the theory of security disposal in China, and puts forward its own legislative concept on the localization of security measures under the criminal policy of tempering justice with mercy.
