城乡建设用地使用权也是一项主要的用益物权,从本质出发,此种物权的流转是一项民事法律行为,但也包含了许多重要的行政法律制度。其改革已经在流转的基本条件、流转的收入分配制度、提高了社会经济水平。指标交易制度、宅基地使用权流转制度等方面都取得了重大进展,与历史的发展进度相适应,对集体建设用地使用权流转这一法律制度的重新构建打下了基础。然而,我国目前的相关制度仍存在法律规定、各政府的规定、主体范围、监督和管理、价格和收入分配以及市场体制等方面存在一些亟待健全的缺陷,而我们要专心致志的解决这些问题,对乡村集体建设用地使用权的流转加以限制,从而达到工农业发展工程的正常运行,促进国民经济发展进程。
The right to use urban and rural construction land is also a major usufruct. Starting from the essence, the transfer of such property rights is a civil legal act, but it also contains many important administrative legal systems. Its reform has been the basic conditions for the circulation of income distribution system, improve the social and economic level. Significant progress has been made in such aspects as the trading system of indicators and the circulation system for the right to use homesteads, which is in line with the historical development and lays the foundation for the reconstruction of the legal system of the circulation of the right to use collective construction land. However, there are still some laws and regulations in our country’s related systems. There are some shortcomings to be solved urgently in the regulations, scopes, supervision and management of the governments, price and income distribution, and market system. All these problems should be resolved with great concentration. The flow of the right to use rural collective construction land shall be limited so as to achieve the normal operation of industrial and agricultural development projects and promote the process of national economic development.
