在儒家丰富多元的政治传统中,宪政儒学基于善治理想的追求,表现为对政治法度之根本构造的关切和知行,围绕政治权力的安顿、规约和限制生发出宪制论述与实践证成两个方面。它与主要由法家型塑的专制性力量之间的对抗,决定了华夏政治文明的优劣与蹎踬。本文概要介绍了近世宪政儒学的三重潮流,初步阐述了其中的重要议题,揭示出宪政主义传统的古典和潜在形态。这种努力试图为宪政主义的共业接引故国文明的地气,推动我们进一步思考如何在宪制秩序的维度上理解善治与自由。
In Confucianism’s rich and varied political tradition, the pursuit of constitutional Confucianism based on the ideal of good governance is manifested in its concern and knowledge of the fundamental structure of political legitimacy. It has also resulted in the establishment of two sets of constitutional statements and practical proofs on the settlement, limitation and restriction of political power aspect. Its confrontation with the tyranny of the rule of law mainly determines the pros and cons of China’s political civilization. This article gives an overview of the triple trend of constitutional Confucianism in the recent history, tentatively elaborates on one of the major topics and reveals the classical and latent forms of the constitutionalist tradition. This effort seeks to connect the generosity of the civilizations of the country with constitutionalism and pushes us to further reflect on how to understand good governance and freedom in the dimension of constitutional order.
