国有资产经济关系是我国社会主义经济关系的重要组成部分。运用法律手段调整国有资产经济关系,是优化国有资产管理,确保国有资产不受侵犯,保障国有资产的保值和增值,发挥国有资产的经济效益,巩固和发展社会主义的经济基础,充分实现国家对国有资产所有权的重要措施。特别是在经济体制改革不断深入的今天,加强对国有资产管理立法,完善国有资产管理法制日益显得尤其重要。笔者拟在分析国有资产管理现存问题的基础上,就国有资产管理立法中的几个问题作些初步探讨。
