九届全国人大常委会第二十四次会议审议通过了《关于修改 <中华人民共和国工会法 >的决定》。这次《工会法》修改的核心是进一步突出工会的维护职能。围绕这一核心 ,新《工会法》明确规定平等协商与集体合同制度、职工代表大会制度是我国社会主义市场经济条件下工会维护职工合法权益的两大主要手段。同时《工会法》对工会的组织建设、工会干部的保护以及法律责任等 ,也都作出了新的规定 ,为工会更好地履行自己的各项社会职能创造了必要的法律条件和环境。
The 24th meeting of the Standing Committee of the Ninth National People’s Congress examined and adopted the Decision on Amending the Trade Union Law of the People’s Republic of China. The core of this amendment to the “Trade Union Law” is to further highlight the function of safeguarding trade unions. Around this core, the new Trade Union Law clearly stipulates the principle of equal consultation and collective contract. The system of workers’ congress is the two major means by which the trade unions maintain the legitimate rights and interests of their employees under the conditions of a socialist market economy. At the same time, the “Trade Union Law” has also set new rules on the organizational construction of trade unions, the protection of trade union cadres and their legal responsibilities, and has created the necessary legal conditions and environment for the trade unions to better fulfill their social functions.
