案例教学法是法学课堂教学改革中推行的一种新型教学方法。19世纪70年代美国哈弗大学法学院院长兰德尔首次在法学教学上引入案例教学法,其不同于判例教学法。法学案例教学法有利于激发学生的学习积极性,学会理论联系实际,从而培养学生的法律思维能力,也有利于教师及时检验教学效果。案例教学的实施需要老师课前精心挑选案例,在课堂上适时地呈现案例并组织学生有的放矢地进行讨论,最后老师要进行必要的点评和总结。基于我国是成文法国家的国情,案例教学法在法学教学中应适度运用,才能取得预期效果。
Case Teaching Method is a new teaching method promoted in law classroom teaching reform. In the 1870s, Randall, the dean of the Harvard Law School in the United States, introduced the case teaching method for the first time in law teaching, which is different from the case law teaching method. Law case teaching method is helpful to arouse students ’enthusiasm for learning, to learn theory with practice, so as to cultivate students’ ability of legal thinking, and also help teachers to test the teaching effect in time. The implementation of case teaching requires the teacher to carefully select the case before class, present the case in time and organize the students to discuss it in a timely manner, and finally the teacher should make the necessary comments and sums up. Based on the fact that our country is a country of statutory law, the case teaching method should be properly used in law teaching so as to achieve the expected result.
