川劳社办[2008]44号为进一步加强对用人单位实行特殊工时制度的管理,维护劳动者合法权益,根据《劳动法》、《劳动合同法》以及劳动部《关于企业实行不定时工作制和综合计算工时工作制的审批办法》(劳部发[1994]503号)、劳动部《关于印发〈国务院关于职工工作时间的规定〉问题解答的通知》(劳部发[1995]187号)等有关规定,现就用人单位实行特殊工时制度的有关具体问题明确如下,请遵照执行。
In order to further strengthen the administration of special working hours system for employers and safeguard the legitimate rights and interests of workers, according to the Labor Law, the Labor Contract Law and the Labor Department's Circular on Undertaking Work in Enterprises (Labor Ministry [1994] No. 503) issued by the Ministry of Labor and the Circular of the Ministry of Labor on Issuing the Questions on the Provisions of the State Council Concerning the Working Hours of Staff and Workers (Laibu Fa [1995] No. 187) And other relevant provisions, the specific problems concerning the implementation of special working hours system by employers are as follows.
