商品房楼花按揭方式最初发源于中国香港,目前国内大多数居民士对楼花按揭制度的法律机理及其运作机制了解的不够透彻,导致在商品房楼花按揭的实际交易过程中,伴随着一系列的法律纠纷的出现。基于上述原因,本文主要研究对象为楼花按揭法律制度问题,通过对楼花按揭的发展历程进行简单概述,分析当前其他国家和地区及我国的楼花按揭制度的现状,通过比较得出当前大陆地区楼花按揭制度存在的一些主要问题。
