政府定价是否是行政许可?如果政府定价是行政许可,《价格法》需修改;如果政府定价不是行政许可,《价格法》与《行政许可法》不发生冲突,不存在适用时遵循哪一部法律的困惑。本文通过政府定价与行政许可的比较,认为政府定价行为中有一部分是行政许可,《行政许可法》实施对政府定价产生了重大的影响。
If the government pricing is an administrative license, the Price Law needs to be revised. If the government pricing is not an administrative license, there is no conflict between the Price Law and the Administrative Licensing Law. Law puzzles. In this paper, the government pricing and administrative licensing comparison, that the government pricing behavior is part of the administrative licensing, “Administrative Permission Act” on the government pricing has had a significant impact.
