本文以北京一起房屋买卖合同纠纷案件为视角,对合同效力认定与标准,房屋中央空调噪声污染与房屋质量的关系,撤销权行使条件以及噪声污染的司法救济途径进行了分析论证。根据最高人民法院关于适用《中华人民共和国合同法》若干问题的解释(一)》第三条、第四条的规定,人民法院确认合同无效,应当以全国人大及其常委会制定的法律和国务院制定的行政法规为依据,不得以地方性法规、行政规章为依据。行为人因对行为的性质、对方当事人、标的物的品种、质量、规格和数量等的错误认识,使行为的后果与自己的意思相悖,并造成较大损失的,可以认定为重大误解。本案房屋噪声污染来源于地下二层中央空调主机,并非上述房屋本身质量所致。不能将中央空调所产生的噪声污染问题作为本案重大误解撤销权行使的法定理由。现房屋所有权人可以与房地产开发商或者物业部门另行协商解决,协商不成的其可以通过民事诉讼方式向人民法院依法提起民事诉讼,从而主张自身的合法权益。
From the perspective of the case of dispute over the sale and purchase of real estate in Beijing, this article analyzes and verifies the validity and standard of contract, the relationship between the noise pollution of houses and the quality of houses, the conditions of the right of cancellation, and the judicial remedy of noise pollution. According to the provisions of Article 3 and Article 4 of the Interpretation 1 of the Supreme People’s Court on the Application of the Contract Law of the People’s Republic of China (1), the people’s court confirms that the contract is invalid and should be governed by the laws of the NPC and its standing committee and the State Council Formulated by the administrative regulations as the basis, shall not be based on local laws and regulations, administrative regulations. The perpetrator may be deemed to be a major misunderstanding because he misunderstands the nature of the act, the variety, quality, size and quantity of the other party and the subject matter, and the consequence of the act runs counter to his own meaning and causes great losses. Noise pollution in this case comes from the second floor of the central air-conditioning underground host, not the quality of the housing itself. The noise pollution caused by central air-conditioners can not be taken as the legal justification for exercising the right of revocation in this case. Now the owner of the house can negotiate with the real estate developer or the property department separately for negotiation. If the negotiation fails, the owner can claim the civil lawsuit to the people’s court through civil litigation so as to advocate its own legal rights and interests.
