信息产权理论是对社会实践的回应,是对现有知识产权理论的扩展。将信息产权理论应用于数据库的法律保护,是未来数据库法律保护的发展方向。我国应该建立符合我国国情的数据库专门法律保护制度,欧盟的数据库特殊权利保护制度是可以借鉴的立法例。
The theory of information property is a response to social practice and an extension of the existing theory of intellectual property. The application of the theory of information property to the legal protection of the database is the development direction of the legal protection of the database in the future.
