“透明度与大众传媒规制”是一个内容很广泛的议题。即使按照《经济、社会、文化权利国际公约》和《公民权利和政治权利国际公约》(以下简称两公约)的要求,把透明度集中到国家机构运作方面,涉及的面也很宽。这个问题事关政府义务、公民的权利和民主制度的完善。所以,既有理论意义,也有实践意义。 一 在人权两公约范围讨论的透明度,是指国家机关在运作过程中,依照宪法、法律和公约之规定把公众应知道的情况,通过一定渠道向公众公布。这是国家机构应承担的义务。一个政府在运作过程中的透明度,标志这个国家自由、民主发展水平和人权
“Transparency and regulation of the mass media” is a very broad topic. Even in the light of the requirements of the International Covenant on Economic, Social and Cultural Rights and the International Covenant on Civil and Political Rights (hereinafter referred to as “the two conventions”), the focus of transparency on the operation of state institutions is very broad. This issue concerns the obligations of the government, the rights of citizens and the improvement of democratic systems. So, both theoretical and practical significance. I.
