0引言《中华人民共和国水法》于1988年颁布实施,迄今已27年之久,有关水利方面的法律也已系统化、制度化,但在实际的水利行政执法过程中仍然是阻力重重、困难重重。2014年汤阴县韩庄乡发生一起占用河道违法建筑的案件,水利主管单位在查处该案过程中,投入大量人力物力,费尽周折,最终该案上诉至法院。这一案件目前尚未得到法院的最终判决结果,但违法者的行为,终将受到法律的严惩。因为水利相关部门工作上的不足,
