随着电子商务应用的发展,基于互联网的药品交易已经成为药品供求新的途径之一。与此同时,利用互联网进行违法药品交易和信息发布的情况有大幅增长趋势,由于交易大多是利用第三方电子商务交易平台,其违法的手段更为隐蔽。鉴于药品属性的特殊性,决定了政府必须参与到互联网药品交易和信息发布活动的监管中,以保障民众用药安全。本文通过对国内外互联网药品交易、信息发布及监管的现状进行分析,统计查办的互联网案件的违法类型、违法主体、违法途径等;对现有的互联网用户就互联网的药品交易和信息发布做问卷调查;以及在借鉴国外监管模式基础上,提出“政府应明确对互联网的药品交易和信息发布监管的指导思想、总体目标和工作原则”。通过发展第三方交易信息发布平台,通过风险分析控制合理有效分配监管资源,通过媒体宣传提高互联网用户的辨别和自我保护能力,对互联网的药品交易和信息发布实施有效监管,将互联网药品交易和信息发布的违法行为的风险压制在可控范围内。 With the development of the application of e-commerce, drug trading based on internet has become one of the new ways of drug supply and demand.
