商标通过充分发挥其功能已经成为我们现代生活中非常重要的一部分了。商标是商标法中最基础的概念,然而关于商标的本质的理论研究却不多。本文通过对商标功能的演变及符号的分析,认为商标的本质是商品和服务提供者结构性信息,商标的价值在于浓缩与产品有关的一切信息。
The trademark has become a very important part of our modern life by giving full play to its functions. Trademark is the most basic concept in trademark law. However, there is not much theoretical research on the essence of trademark. Through the evolution of trademark functions and symbolic analysis, this paper argues that the essence of trademarks is the structural information of goods and service providers. The value of trademarks lies in the concentration of all information related to products.
