《国有企业领导人员廉洁从业若干规定(试行)》(以下简称《若干规定》)第五条规定了国企领导人员应当忠实履行职责,不得有以权谋私、损害企业利益的违规行为。该条款是对国企领导人员忠实义务的规定。国企领导人员不仅要对国家和出资人负责,也应当对其所在的国有企业负有忠实义务。
Article 5 of the Provisions on Certain Probably Honest Practitioners in State-owned Enterprises (Trial Implementation) (hereinafter referred to as “Certain Provisions”) stipulates that the leading personnel of State-owned enterprises shall perform their duties faithfully and shall not be subject to any irregularities that exploit their rights for personal gain or damage the interests of enterprises. This clause is a requirement of faithful obligations to the leaders of state-owned enterprises. The leaders of State-owned enterprises should not only be responsible for the state and the investors, but also have the loyalty to the state-owned enterprises in which they belong.
