近两年来,我国国际商事仲裁机构出台了9部《仲裁规则》。以当前国际主流仲裁机构《仲裁规则》为鉴,上述9部《仲裁规则》从不同侧面体现了我国国际商事仲裁规则的新发展,包括规则适用理念的现代化、仲裁庭自裁管辖权、尽量使仲裁协议有效、平衡推进仲裁程序、增加临时性保全措施的种类和发布主体、设立紧急仲裁庭制度、区别对待追加仲裁当事人和案外人、重视合并仲裁案件的关联性和先后顺序、建立友好仲裁制度、设立案件受理后仲裁庭组成前的调解制度、仲裁规则结构安排、仲裁语言选择等方面。这些仲裁规则的制度创新成果已引起仲裁实务、司法界的积极回应,亟待我国仲裁立法的终极回应。
In the past two years, China’s international commercial arbitration institutions have promulgated 9 “rules of arbitration.” Taking the “Arbitration Rules” of current international mainstream arbitration institutions as a reference, the above-mentioned 9 “Arbitration Rules” embody the new developments of China’s international commercial arbitration rules from different aspects, including the modernization of the applicable concepts of the rules. The arbitration tribunal dictates its jurisdiction and tries its best to make the arbitration The agreement effectively promotes the arbitration procedure in an even and balanced manner, increases the types of temporary preservation measures and the main body of the release, sets up an emergency arbitration tribunal system, treats parties involved in arbitration and outsiders differently, emphasizes the relevance and precedence of merger cases, establishes a friendly arbitration system, The establishment of the arbitration tribunal before the formation of the case after the mediation system, the structure of arbitration rules, arbitration language selection and so on. The institutional innovation of these arbitration rules has aroused the practice of arbitration and the active response of the judiciary, which calls for the ultimate response to our country’s arbitration legislation.
