依照我国现行的土地政策和法律规定,国有土地使用权的取得仍然是“双轨制”:一是国家无偿划拨方式;二是国家通过招拍挂出让方式。无论是通过划拨方式、还是出让方式取得的国有土地使用权,在进入“二级市场”交易时,抑或因使用者主体的变更、地上建筑物、构筑物的转移等因素,都必须到土地管理部门办理土地使用权的变更登记手续。一、国有土地使用权在转让过程中,土地管理部门在办理土地变更登记时,是否对土地使用权转让合同进行实质性审查
According to China’s current land policies and laws and regulations, the acquisition of the right to use state-owned land is still “dual-track system”: one is the method of state-free allocation; the other is the way the state transfers through bidding and auctioning.
