随着社会的快速发展,人民调解的发展经历了一个否定之否定的过程,它在社会转型中经历了低谷,又迅速成为人们重视的纠纷解决途径。非诉讼纠纷解决机制的回归也使人民调解深受国际社会的推崇,被誉为“东方经验”。然而,伴随当前社会日益明显的多元化趋势,人们的民主法制意识不断增强,维护自身权益的要求日益强烈,社会管理的创新迫切需要现今的人民调解进行现代转型,具有不同于传统人民调解的重新定位。《人民调解法》的出台,有效地解决了其中最为关键的问题,但并没有彻底解决所有的问题,关于我国的人民调解制度仍有大量的工作要做,人民调解的行政化、司法化以及多元化问题仍需要我们给予更多的关注。

The administration of the people, the judicialization of the people’s mediation, Diversification still requires more attention from us.
