言论自由是公民的一项基本政治权利,它通常被认为是现代民主中一个不可或缺的概念,不应受到政府的审查。但事实上,不加限制地开放言论,也会引起如诽谤等侵犯他人人格尊严、名誉权的行为。尤其是近年来,随着网络的迅速发展,诽谤行为通过网络频频发生,传播速度更快、范围更广,影响也更加恶劣,引起社会广泛关注。而我国目前还没有制定出一部专门的法律来系统地、全面地规范网络诽谤行为,仅在部分法律中涉及了某些网络侵权、网络犯罪问题。如何实现名誉权与言论自由这两大权利的平衡,是诽谤制度应该关注的问题。本文先对诽谤行为进行了界定,简单地分类研究了网络诽谤行为。
Freedom of expression is a citizen’s basic political right. It is generally regarded as an indispensable concept in modern democracy and should not be subject to censorship by the government. However, in fact, opening up unrestricted remarks can also cause acts such as defamation infringe upon the dignity and reputation of others. Especially in recent years, with the rapid development of the Internet, defamatory acts occur frequently through the Internet, spreading faster, wider and with more adverse effects, causing widespread concern in the society. At present, our country has not yet formulated a special law to systematically and comprehensively regulate internet defamation. Only some laws cover some issues of cybercrime and cybercrime. How to realize the balance between the rights of fame and freedom of speech is the question that the defamation system should pay attention to. This article first defines the defamation behavior and simply classifies the internet defamation.
