日常监督检查中,常发现一些医疗机构将“卫消准字”的产品作药品使用,如一些治疗妇科疾病的栓剂、洗剂(大多是《中华人民共和国药典》收录的药品,但批准文号是“卫消准字”)。对此,有些执法人员将其认定为使用假药而给予处罚;而另有些执法人员则认为不违反《药品管理法》等法律、法规的规定,不应给予处罚。认识上的不统一,造成执法的不一致、不公平。笔者认为,医疗机构使用“卫消准字”的产品是否属于使用假药,可从以下几方面分析:
