在我国经济转型的过程中,劳动关系发生了巨大的变化,劳动关系更为直接和对立,劳资纠纷日益常态化。以劳动争议作为代表劳动关系状况的一个综合性指标,考察影响劳动争议案件的因素,包括新《劳动合同法》的颁布、经济转型、经济发展水平、劳动力教育水平、工会组建、劳动报酬六个主要因素,并进行实证检验,在此基础上提出相应的解决办法与建议,对于正确认识和处理我国新时期劳动关系具有重要的理论与实践意义。“,”In the transition period,labor relations in our country has undergone tremendous changes by becoming more direct and adversarial.And the labor disputes have become more common.This study aims to use labor disputes as a comprehensive indicator to represent the current state of labor relations,and explore the influencing factors on labor dispute cases by some empirical tests,followed by corresponding solutions and suggestions.The factors include the new enacted "Labor Contract Law",economic transition,economic development,and the educational level of labors,union organizing,and the labor remuneration.On the basis of this study,some solutions and suggestions should be proposed in order to understand and deal with the labor relation both in theory and in practice.
