民事诉讼中的保全制度对于保障民事判决的执行具有十分重要的意义。随着我国法治建设的不断发展,保全制度的功能不仅限于保障民事判决的执行,而是呈现出多方面的功能。在司法实践中,保全制度的有些规定缺乏相应的可操作性,对于保全制度功能的发挥还不够充分。在此背景下,本文对于民事诉讼中保全制度的功能以及如何发挥这些功能进行了具体的描述。
The system of preservation in civil litigation is of great significance to the protection of the execution of civil judgments. With the continuous development of the rule of law in our country, the function of the preservation system is not limited to the protection of the enforcement of civil judgments. Instead, it shows a wide range of functions. In judicial practice, some provisions of the preservation system lack corresponding operability, and the functions of the preservation system are not fully demonstrated. Against this background, this article gives a concrete description of the functions of the preservation system in civil litigation and how to play these functions.
