对美国专利制度演化历史的回顾或可有助于认识20世纪80年代后美国再度强盛的理由,因为由经济学主要关注的经济政策并不能概括全部。联邦最高法院对Diamond v.Chakrabarty案的判决打开了可专利主题大门,联邦巡回上诉法院的构建并继而成为美国专利制度的实施中枢,国会通过《拜杜法》以激励科技创新和技术转移,联邦政府在涉外贸易事务中积极维护美国的产业利益等,皆为美国专利制度演化中的浓墨重彩事件。持久的科技创新能力、合理的专利制度和完善的法治社会环境,构成支撑美国知识经济时代的重要因素。
A review of the history of the evolution of the U.S. patent system may help to shed some light on the prospect of renewed strength in the United States after the 1980s because economic policies that are primarily concerned with economics can not be generalized. The Federal Supreme Court’s decision on the Diamond v. Chakrabarty opened the patented thematic gate, the construction of the Federal Circuit of Court of Appeals and then the center of implementation of the U.S. patent system, which passed the Baidoa Act to stimulate technological innovation and technology transfer, the federal The government actively defends the industrial interests of the United States in foreign trade affairs and so on, all of which are incisive events in the evolution of the U.S. patent system. Long-lasting scientific and technological innovation, a reasonable patent system and a sound social environment for the rule of law constitute an important factor supporting the era of the knowledge-based economy in the United States.
