劳动争议案情:申诉人:农民工曾某某于2002年7月28日持公安部门核发的《爆破证》,到某金矿寻找工作,即被金矿760硐承包人孔某某雇为矿石爆破工。在2002年11月10日下午2时,曾某某进入矿硐准备打炮眼时,突然硐壁上方的石块滚落,砸伤右脚,送县医院住院治疗59天。诊断为:右胫腓骨闭合性骨折:右小腿骨筋胫室综合症。医疗终结后,曾某某经县劳动行政部门认定因工负伤。经县劳动能力鉴定委员会鉴定:伤残六级。因医疗费、抚恤费等工伤待遇问题,申诉人与承包人发生争议,承包人孔某某则逃之夭夭。申诉人要求发包单位金矿解决,金矿推脱未与申诉人建立劳动关系,不肯承担任何责任。于是,申诉人于2003年2月18日向县劳动争议仲裁委员会申请仲裁,要求金矿(被诉方)给付:医疗期间的工资3000元,医疗费3800元(承包人已付医疗费除外),一次性伤残抚恤费58580元等。仲裁结果:仲裁委立案受理后,被诉方(金矿)仍对《工伤认定结论》持有疑义,依法申请上级劳动行政部

As a result, the claimant applied for arbitration to the County Labor Dispute Arbitration Commission on February 18, 2003, and requested the gold mine (the respondent party) to pay: 3,000 yuan for medical treatment and 3,800 yuan for medical expenses (except for contracted medical expenses already paid by the contractor) One-time disability pension 58580 yuan and so on. Arbitration Result: After the arbitration commission accepted the case, the respondent (gold mine) still held doubt on the conclusion of the determination of industrial injury and applied for the superior labor administration department
