根据《联合国禁止酷刑公约》的规定,签约国仅同意对官员个人提起刑事诉讼,但是否可以提起民事赔偿却不清楚。国家豁免权为个别犯罪官员提供了事实上的刑事控诉庇护,但将豁免权扩大到官员个人在国际法上缺乏权威依据。解决受害者要求赔偿的指控需要面对两个棘手的问题,即对相关行为的民事管辖权和国家豁免权的否认。虽然国际法上对酷刑的民事管辖依据尚无无明文的规定,但至少不违反国际法和国内法。
Under the UN Convention Against Torture, signatories agree only to criminalize individual officials, but it is unclear whether civil remedies can be brought. State immunities provide de facto criminal prosecution coverage for individual criminal officials, but the extension of immunity to individual officials lacks authority in international law. Addressing allegations of victim claims requires two difficult questions: the civil jurisdiction of the act in question and the denial of state immunity. Although there is no express statutory basis for the civil jurisdiction of torture in international law, at least it does not violate international law and domestic law.
