文盲宜不宜当人大代表?目前存在两种不同意见。一种意见认为,文盲可当选人大代表,这是符合宪法有关规定的精神的,对文盲当选人大代表进行人为的限制和干预,就有“违宪”之嫌。另一种意见认为,文盲不宜当人大代表。在选举活动中对人大代表候选人依法提出与代表职责相关的素质包括文化素质的要求,不仅不是限制或者剥夺某些选民的被选举权,而且是实施宪法和法律的内在要求。我们认为,尽管目前各级人大代表中的文盲极少,但对这个问题,从法理上作一些探讨,对于促进各地进一步拓宽代表工作思路,完善代表选举工作制度,提高代表素质,会产生一定的积极作用。因此,我们编发了两篇观点不同的文章,以期引起大家对如何提高代表素质问题的关注。
Illiteracy should not deputies? There are two different views. One opinion holds that illiteracy can be elected as deputies to the NPC and deputies, which is in keeping with the spirit of the relevant provisions of the constitution. There is a suspicion of “unconstitutionality” for artificially restricting and intervening illiterate elected deputies. In another opinion, illiteracy should not be deputies. In the election activities, the requirements on the qualifications and cultural qualities of candidates for deputies according to the law that are related to their deputies’ responsibilities are not only not to restrict or deprive some voters of their right to vote, but also to impose the constitutional and legal requirements. We believe that although there are currently very few illiterates among people’s deputies at all levels, some discussions on this issue from the jurisprudence are of great significance in promoting the further broadening of the thinking of representative work in various places, perfecting the work system of representative elections and improving the quality of deputies positive effects. Therefore, we compiled two articles with different views in order to arouse people’s attention on how to improve the quality of representativeness.
