本文结合传世文献与简牍材料对汉代赎罪问题进行了较全面的探讨,并对密切相关的汉代赎刑制度作了必要的分析。汉代“赎罪”有三种含义(一)指依照法律条文应处以“赎刑”之罪,是一个概括性的“罪”的概念;(二)指舍弃本刑而易科赎刑或以其他法定的方式除罪,是一种刑罚执行方式;(三)指在法律制度外,通过缴纳钱财、削除爵位、提供战功或劳役及其他途径除罪、减刑。这三种意义上的“赎罪”在汉代一直存在,而其具体内容则随着法律制度的变革和时代变迁而变化。
This article combines the handed down literature and the Jane bamboo material to carry on a more comprehensive discussion to the issue of atonement in the Han Dynasty, and makes the necessary analysis to the related ransom system in the Han Dynasty. There are three meanings of “Atonement” in the Han Dynasty. (1) It refers to the crime of “redemption” in accordance with the law and is a general concept of “sin.” (3) Refers to outside the legal system, through the payment of money, the removal of the title, to provide combat or labor and other means in addition to crime, commutation of the sentence. In the three sense of “atonement” in the Han Dynasty has always existed, and its specific content with the legal system changes and changes in the times change.
