代孕技术作为一种医学生殖手段,给万千家庭带来希望,同时也产生了一系列社会问题和法律纠纷。虽然我国卫生部通过部门规章规范代孕行为,但也仅仅是从规章层面上对代孕行为进行规制,现行法律对此并没有相关规定。为避免代孕形成的派生性犯罪,应该对代孕行为刑法化,通过禁止传统代孕、规范商业性代孕等刑法化途径来降低犯罪风险,促进科学立法,保护行为人合法权益。
Surrogacy technology as a means of medical reproduction, to bring hope to thousands of families, but also produced a series of social problems and legal disputes. Although our country’s Ministry of Health regulates surrogacy through departmental rules and regulations, it only regulates surrogacy from the regulatory level. There is no relevant stipulation in current laws. In order to avoid the derivative crime of surrogacy, the criminalization of surrogacy should be criminalized, the criminal risk should be reduced by prohibiting traditional surrogacy, regulating commercial surrogacy and other criminalization, promoting scientific legislation and protecting the legitimate rights and interests of actors.
