对于“控制权”的规定是《鹿特丹规则》在“货物交付制度”上的创新。但该公约并未对如何协调控制权和传统的凭单放货制度之间的关系问题进行规定。货物控制权制度不应动摇凭单放货制度的基础,凭单放货仍然是国际货物运输的基本制度,而控制权应作为凭单放货制度的例外情形。
The regulation of “control” is an innovation of the “Rotterdam Rules” in the “system of delivery of goods”. However, the Convention does not regulate how to reconcile the relationship between control and the traditional voucher delivery system. The system of control of goods should not shake the basis of voucher delivery system. Voucher delivery is still the basic system of international carriage of goods, and control should be used as an exception to the voucher delivery system.
