回顾喜马拉雅条款在当代航运中的起源发展、海运国际公约对其的吸收借鉴,并以港口经营人为例,分析《鹿特丹规则》对喜马拉雅型保护的影响及适用公约寻求喜马拉雅型法定保护存在的问题。当今港口经营人与承运人的差别缩小,虽然被纳入承运人的责任模式,但由于《鹿特丹规则》结构上的不足,使得公约下港口经营人援引喜马拉雅型法定保护在抗辩、责任限制、责任期间、法院管辖等方面尚存一些不易察觉的问题。
Recalling the origins and development of the Himalayan terms in modern shipping and the international conventions on maritime transport, and taking the port operator as an example, this paper analyzes the impact of the Rotterdam Rules on Himalayan type protection and applies the convention to seek Himalayan legal protection. Although the differences between port operators and carriers are narrowed nowadays and are included in the responsibility model of carriers, due to the structural deficiency of the Rotterdam Rules, the port operators under the conventions have invoked Himalayan-type statutory protection in defenses, limitation of liability and period of responsibility , The court jurisdiction and so there are still some problems not easily noticeable.
