随着我国民事诉讼模式的转变,当事人主义诉讼模式在我国逐步确立,但该模式的确立引发了一个问题:在诉讼中因当事人自身欠缺法律知识,致使其提出的诉讼主张含糊不清,与法官沟通存在障碍,进而影响整个诉讼的顺利进行。为解决这一问题,释明权制度具有不可替代的优势,其能够有效弥补当事人主义诉讼模式的缺陷,解决当事人诉讼能力不足等问题,因此,为更好地发挥释明权制度的作用,本文对完善我国释明权制度进行简要分析。
