随着世界经济的全球化进程加快,国际贸易量的迅速增加,作为主要运输方式的航运日益显示其重要性,谋求海上货物运输方面法律的全球化成为了世界各国努力的目标,也是海上货物运输方面法律发展的必然趋势。任何一个关于国际海上货物运输的国际公约或国内法,承运人的责任基础始终处于其核心地位,它决定着海上货物运输法的基本特征与价值取向。纵观海上货物运输国际公约的沿革意义脉络,不难发现,承运人责任基础的改变,是海上货物国际公约演变的标志。因此,本文旨在通过对《鹿特丹规则》下的承运人责任基础的研究,探寻在构建我国《海商法》关于承运人责任基础问题上应做出的调整以及对于《鹿特丹规则》该问题的分析。
With the globalization of the world economy accelerating and the volume of international trade rapidly increasing, shipping as the main mode of transport has increasingly shown its importance. The globalization of laws in the carriage of goods by sea has become the goal of all countries in the world and the goal of maritime transport of goods The inevitable trend of legal development. Any one of the international conventions on the international carriage of goods by sea or the domestic law, the carrier’s responsibility is always at the core of its position, which determines the basic characteristics of maritime goods transport law and value orientation. Looking at the evolution of the international conventions on the carriage of goods by sea, it is not difficult to find that the change of the carrier’s responsibility base is a sign of the evolution of the international conventions on maritime goods. Therefore, the purpose of this paper is to explore the adjustments that should be made in establishing the basis of carrier liability in China’s Maritime Code, as well as the analysis of the Rotterdam Rules, by studying the carrier’s liability under the Rotterdam Rules .
