食品安全与国民生活息息相关,是社会一直关注的焦点。近年来,食品安全事故问题频繁发生,引起了国家立法机构的关注,2015年11月《食品安全法》进行了第一次修正,对其中的惩罚性赔偿规定加大了惩罚力度。而惩罚性赔偿制度的基本内涵是什么,怎么更好地通过惩罚性赔偿制度来控制和减少食品安全事故发生的概率,是惩罚性赔偿制度研究的重点。所以,本文在阐述了惩罚性赔偿制度内涵、功能的基础上,对比分析《食品安全法》关于惩罚性赔偿制度的新旧条文,进一步提出完善的建议。
Food safety is closely linked with the life of the people and has always been the focus of our society. In recent years, the frequent occurrence of food safety accidents has aroused the concern of the national legislature. In November 2015, the Food Safety Law was amended for the first time, and penalties were increased for the punitive damages stipulated therein. However, what is the basic connotation of the punitive damages system and how to control and reduce the probability of food safety accidents through the punitive damages system is the focus of the research on the punitive damages system. Therefore, on the basis of expatiating on the connotation and function of the punitive damages system, this article comparatively analyzes the new and old provisions of the Food Safety Law on punitive damages, and puts forward further suggestions.
