法只有根据一个它在自身中完全抽象掉的内容(生产关系)才存在。正是它的这种独特状况,解释了马克思的经典提法:法通过在自己的规则系统中完全不提生产关系,正好相反,通过掩盖它们而“表现”了生产关系。法是一套系统化、无矛盾、(倾向于)完备的形式系统,但它无法独自存在。一方面,它依赖于一部分镇压性国家机器;另一方面,它依赖于法律意识形态,还要依赖于道德意识形态的小小补充。
The law exists only on the basis that it is a complete abstraction of itself (the relations of production). It is precisely this unique situation that explains Marx’s classic formulation: Law does not at all mention producing relations in its own system of rules; on the contrary, it “expresses” the relations of production by covering them. Law is a systematic, non-contradictory, (tendentious) complete formal system, but it can not exist on its own. On the one hand, it relies on a part of repressive state apparatus; on the other hand, it relies on legal ideology and on a small supplement to moral ideology.
