产权是人们围绕某种资源的有用属性发生的多维权责关系,均衡需要所有主体对彼此行为权在认识上达成一致,这需要长期相互学习和磨合,需要政府法规确认和引导。城市地下空间作为一种实用价值日益凸现的经济资源,其产权稳定均衡的达成需要所有相关利益主体间的长期磨合和学习,以及政府的引导和确认。西方城市地下空间产权变迁历史也验证了这一点。因此,中国城市地下空间产权制度的制定应该:第一,参照地表,实际单设地下空间权;第二,照顾所有主体的利益关系,尊重传统和习俗;第三,注重正式法律法规的制定,更加重视相关条款的宣传;第四,要稳妥渐变,不追求一蹴而就;第五,考虑中国的特殊情况。
Property rights are multi-dimensional rights-and-responsibilities relationships that occur around a resource’s useful attributes. Equilibrium requires that all parties agree on each other’s rights of action. This requires long-term mutual learning and adjustment and the need for government regulations to confirm and guide them. Urban underground space, as a kind of economic resource whose practical value is becoming more and more prominent, needs stable and balanced ownership of property rights. It requires the long-term running-in and study of all relevant stakeholders and the government guidance and confirmation. The history of the change of property rights in the underground space in western cities also verifies this point. Therefore, the formulation of the property right system of Chinese urban underground space should include: first, referring to the surface and actually setting up the right of underground space; secondly, taking care of the interests of all the main parties and respecting the traditions and customs; third, paying attention to the formulation of the formal laws and regulations, Pay more attention to the propaganda of the relevant articles; fourthly, we should make steady progress and gradualism instead of pursuing in a single step; and fifth, we should consider the special circumstances of China.
