以浙江省龙泉市为研究区域,对该市2008—2016年林权不动产登记工作进行研究,分析集体林权制度改革各阶段措施及遗留问题。以村规民约与法律法规间的冲突为切入点,在林权不动产继承登记工作中引入司法公证,司法部门的调查取证权能有效解决不动产登记机构对申请材料只能进行书面审查的掣肘,化解因重男轻女的思想而对不动产登记工作的误解,提高登记申请材料的真实性。
Taking Longquan City of Zhejiang Province as the research area, this paper studies the registration of forest tenure from 2008 to 2016 in this city and analyzes the various measures and problems left over during the reform of collective tenure. Taking the conflict between village regulations and laws and regulations as the starting point, judicial notary is introduced in the inheritance and registration of forest property rights and the investigation and evidence collection right of the judicial department can effectively solve the problem that the real estate registration agency can only conduct the written examination of the application materials. Due to the patriarchal ideology and real estate registration misunderstanding, to improve the authenticity of the application materials.
