临时工,一个在法律意义上并不存在的用工形态,如今却大量存在于多个行业,并引发“临时工现象”。行政执法中临时工普遍存在,究其原因有诸多方面,最根本的原因是近年来政府的社会管理能力不足,依靠大量临时聘用人员协助社会管理。素质低下的执法人员不是在增加政府的执法力量,而是在瓦解法律的权威和减弱执法者的能力,因此不得聘用编制外的临时工。政府通过简政放权,将权力下放给市场和社会,缓解执法不力的压力。
Temporary workers, a form of employment that does not exist in the legal sense, now exist in large numbers in many industries and trigger “temporary workers.” There are many reasons for this. The most fundamental reason is that the government lacks social management capability in recent years and relies on a large number of temporary hires to assist social management. Instead of hiring law enforcement officials outside the government, law enforcement officers with low quality are not only increasing the authority of the law but also weakening the ability of law enforcement officials. Through simple government and decentralization, the government decentralized power to the market and society and alleviated the pressure of ineffective law enforcement.
