劳教制度产生于于50年代的肃反,是我国一项特有的教育改造制度。最早关于劳教的法律,是1957年8月1日由全国人大常委会批准的《国务院关于劳动教养问题的决定》(简称《决定》)。《决定》中指出设置劳教制度是为了把游手好闲、违反法纪与不务正业的人改造成自食其力的新人,以此来维护公共秩序,以便更好的搞好社会主义建设。它是我国独有的,是具有中国特色的一种教育改造制度。虽然从它产生以来,对于维持社会指数,预防犯罪发挥了一定的作用,但是也造成了一些负面影响,极大的影响了正常的社会生活,侵犯了公民权利。
The system of labor camps originated in the anti-revolution in the 1950s and is a unique system of education and reform in our country. The earliest law on labor camps was the “Decision of the State Council on Re-education through Labor” (abbreviated as “decision”) approved by the Standing Committee of the National People’s Congress on August 1, 1957. The “Decision” pointed out that setting up a system of labor camp education is to safeguard the public order in order to better socialist construction by reforming the idle, violating the law and discipline and turning a blind eye to the new self-reliant. It is unique to our country and is an education reform system with Chinese characteristics. Although it has played a certain role in maintaining social indices and crime prevention, it has also had some negative impacts, greatly affecting normal social life and violating civil rights.
