本文从罗马法与普通法在地产权制度方面的比较开始,分析了所有权这一概念在普通法地产权制度中的不适宜性,并提出用地产权概念取代所有权的建议,以达到更好理解普通法地产权制度的目的;然后又以罗马法的所有权为参照,剖析了地产权的一些特性,以及它与占有的关系。本文的目的不在强调罗马法和普通法之间在不动产权利方面的区别,相反,作者认为这二者之间在实质上是相通的,而它们之间的所谓的区别只不过在于彼此的陌生,因此作者突出强调了要从历史角度对普通法地产权制度进行理解的重要性。
This article starts from the comparison between the Roman law and the common law in the system of the property rights, analyzes the inappropriateness of the concept of ownership in the common law property system, and puts forward the suggestion of replacing the ownership by the concept of the property rights so as to achieve a better understanding of the general Then, taking the ownership of Roman law as a reference, this paper analyzes some characteristics of the property rights and its relationship with possession. The purpose of this paper is not to emphasize the difference between the Roman law and the common law in terms of real property rights. On the contrary, the author thinks that the two are essentially interlinked, and the so-called differences between them are only those of strangers, Therefore, the author highlights the importance of understanding the common law property system from a historical perspective.
