通过对孔祥俊法官所著《司法理念与裁判方法》的解读,探析当下司法制度运行背后的实用主义思潮、司法能动的哲学倾向以及转型期中国司法的现实策略、理念和法律适用方法。整体性衡平是一种温和的、讲究策略的司法能动主义,对中国社会现实和司法实践产生了深刻影响。当下中国司法运行要探析实用主义思潮的影响和后果,在强调法治原则的基础上有限度地发挥司法能动主义的作用。在具体的司法运行策略中,以提高法官司法能力为依托,以强调法律效果为基础,建立更加适合乡土中国的司法运作模式。在法律适用方法上,规则选择中的价值判断不可避免,应在坚持法律事实优先的基础上,保持对客观真实的法律追问。
Through the interpretation of Judge Kong Xiangjun’s “Judicial Idea and Judgment Method”, I analyze the philosophical tendency of pragmatism and judicial activeness behind the current judicial system operation as well as the practical strategies, concepts and applicable law of Chinese judicature in the transition period. Holistic balance is a gentle and tactful judicial activism that has a profound impact on the social reality and judicial practice in China. At present, China’s judicial operation should probe into the influence and consequence of the pragmatist trend of thought, and exert the function of judicial activism to a limited extent on the basis of emphasizing the rule of law. In the specific judicial operation strategy, based on the improvement of the judicial ability of the judiciary, the judicial operation mode that is more suitable for the native China is established on the basis of emphasizing the legal effect. In the application of law, the value judgment in the choice of rules is unavoidable. On the basis of giving priority to legal facts, we should keep the law querying objectively and truthfully.
