网络社会使保障公民的言论自由和管控网络秩序之间产生了紧张的关系,以往的法律法规在界定“网络谣言”、处理这一关系时呈现出明显的不适应。目前,刑事和民事领域分别出台了专门的司法解释、修法和规定,但在行政法领域还未有统一的意见。笔者在分析专门的刑事司法解释的基础上,结合有关民事规定和刑法修正案九的有关规则,以行政法的角度,从实施主体、主客观相一致、行为方式等方面提出“网络谣言”界定标准的若干意见,供学界和实务界参考。
The Internet society has made the tensions between protecting the freedom of speech of the citizens and the control of the network order. The former laws and regulations showed obvious incompatibility in defining the “network rumor” and handling the relationship. At present, the criminal and civil fields respectively issue special judicial interpretations, revision laws and regulations, but there is no unified opinion in the field of administrative law. Based on the analysis of the specific criminal judicial interpretation, combining with the relevant rules of the Civil Regulations and the Criminal Law Amendment 9, from the perspective of the administrative law, we propose “network rumor ”A number of opinions defining standards for reference by academics and practitioners.
