不动产物权登记的主要作用在于通过确认物权归属来稳定物权关系,公示物权信息,进而保障不动产交易安全,达到为物权提供事先保护的目的。其在法律性质上属于公法证明行为,是对既存的、先发的、实质的物权的证明形式,而不属于行政确权行为。不动产登记不是实质物权的唯一证明形式,任何具备能够从客观上认定物权变动的形式要件,就应当被作为与不动产物权登记一样有效的物权公示方式。
The main function of the registration of real property rights is to stabilize the property rights by confirming the ownership of the real right, publicize the real right information, so as to ensure the security of real estate transactions and achieve the purpose of providing prior protection for the real rights. It belongs to the proof of public law in the nature of law. It is a form of proof of the existing, the first, the substantive real right, and not an act of administrative confirmation. Real estate registration is not the only form of substantive real right, and any form element that can objectively determine the change of real right should be regarded as the effective way of publicity of real property registration.
