随着三网融合的加速和手机上网用户的快速增长,网络应用呈现多元化,新的网络时代已来临,从早期的商标、商号到传统互联网的域名、通用网址,再到当前移动互联网的无线网址,企业品牌保护的内涵已悄悄发生变革。本文分析了以通用网址、无线网址为代表的网址标识与商标之间的冲突,并阐述了2010年8月29日新施行的《通用网址争议解决办法》和《无线网址争议解决办法》修订案的三大调整,以期为企业在新网络环境下构建全网知识产权保护提供借鉴意义。
With the acceleration of triple play and rapid growth of mobile Internet users, diversified network applications, the new Internet era has come, from the early trademark, trade name to the traditional Internet domain name, universal Web site, and then to the current mobile Internet wireless Website, corporate brand protection has quietly changed the connotation. This article analyzes the common web site, wireless Web site as the representative of the logo and the conflict between the trademark, and expounded on August 29, 2010 the new implementation of the “Universal Web Site Dispute Resolution” and “Wireless Web Site Dispute Resolution” Amendment In order to provide reference for enterprises to construct the whole network of intellectual property protection under the new network environment.
