由于我国尚未建立保障普遍、充分的养老体系,老人在退休后继续再就业的情况很普遍。通常情况下,60岁以上老人,一般应推定为无劳动能力,若此时老人不幸遭受人身损害,能否主张误工费呢?2013年7月5日,某运输公司驾驶员驾驶一辆货车上路行驶时,68岁的许老伯正巧在人行横道上过马路。由于驾驶员违反让行规定在人行横道线上撞倒许老伯,导致其倒地受伤。许老伯被诊断为左腓骨骨折,经鉴定伤情构成道路交通事故伤残九级。由于赔偿费用无法达成一致,许老伯遂向法院提起诉讼。
