【摘 要】
：
《民法典》第四百九十五条从立法上确立了预约合同制度,但对于预约合同违约责任方式及赔偿范围未予以明确,仍有解释上的空间.商品房买卖预约合同的违约责任范围除了一般合同适用的定金及违约金之外,还应当充分考虑履行利益损失、信赖利益损失及部分机会损失.同时当结合诚实信用原则及利益平衡原则的综合考虑,通过对商品房预约合同的效力做类型化区分,从而确定违约赔偿范围.
